Section 3.02 – Qualification of Mayor and City Commissioners: Any qualified Broward County elector whose principal place of residence is in the City of Lauderdale Lakes and who has resided continuously in the city for six (6) months immediately preceding his qualifying as a candidate for the office shall be eligible to hold the office of mayor or city commissioner.

Form of Government: The form of government of the city shall be a mayor/city commission/city manager form of government. All legislative, regulatory and policy-making powers of the city shall be vested in the city commission. All administrative powers of the city shall be vested in the city manager, and the city manager shall provide for the performance of all duties and obligations imposed on the city by law, through its various departments and divisions. Pursuant to City Charter Section 3.01

Qualifying Officer: The City Clerk is the Qualifying Officer for the City of Lauderdale Lakes. Pursuant to F.S. 99.061(7)(c), the Municipal Clerk, as filing officer, performs only a ministerial function in reviewing qualifying papers. In determining whether a candidate is qualified, the filing officer shall review the qualifying papers to determine whether all items required have been properly filed and whether each item is complete on its face, including whether items that must be verified have been properly verified (by oath or affirmation) pursuant to F.S. 92.525(1)(a).

What is a candidate?

A candidate, as defined in F.S. 97.021(4), is any person to whom any one or more of the following applies:

1. Any person who seeks to qualify for nomination or election by means of the petitioning process.

2. Any person who seeks to qualify for election as a write-in candidate.

3. Any person who receives contributions or makes expenditures, or gives his/her consent for any other person to receive contributions or make expenditures, with a view to bringing about his/her nomination or election to, or retention in, public office.

4. Any person who appoints a treasurer and designates a primary depository.

5. Any person who files qualification papers and subscribes to a candidate’s oath as required by law.

Who can be a candidate?

To become a candidate in the City of Lauderdale Lakes, you must:

1. Be a bona fide resident and citizen of the City of Lauderdale Lakes, a resident of the State of Florida, and a citizen of the United States of America;

2. Be duly qualified to vote at City, State and National Elections;

3. Shall have resided in the City for at least six (6) months immediately preceding the date of election, as evidenced by City voter’s registration documentation; and

4. Shall be otherwise qualified as provided in the City Charter.

When may I announce my candidacy?

You may “announce” your candidacy at any time, however:

1.F.S. 106.021 provides that BEFORE you accept contributions or make any expenditures, you must file your Appointment of Campaign Treasurer and Designation of Campaign Depository (Form DS-DE 9) with your qualifying officer (City Clerk). This form contains the following information:

a. Your name, address, e-mail address and telephone number

b. Your political party, if you are a partisan candidate

c. Office sought, including district and group number if applicable

d. Name, address and telephone number of your campaign treasurer

e. Name and address of your depository (bank)

f. Your signature

g. Signature of campaign treasurer, showing acceptance of appointment

2. A candidate may appoint herself/himself as campaign treasurer.

Note: Only a campaign treasurer or deputy campaign treasurer is allowed to sign checks drawn on the campaign account. The campaign treasurer or deputy campaign treasurer who signs a check shall be responsible for the completeness and accuracy of the information on the check and for ensuring it is an authorized expenditure. Candidates are prohibited from signing campaign checks unless they appointed themselves campaign treasurer or deputy campaign treasurer.

3. F.S. 106.023 requires that within 10 days of filing the Appointment of Campaign Treasurer and Designation of Campaign Depository(Form DS-DE 9), you must file a Statement of Candidate (Form DS-DE 84) with your qualifying officer, stating you have received, read and understand the requirements of Chapter 106, Florida Statutes.
